Terms and Conditions

These Terms and Conditions are the rules for using SabayApp (the app, the web app and sabay.binary.ph). By creating an account or using SabayApp, you agree to them and to our Privacy Policy. If you do not agree, please do not use SabayApp.

1. What SabayApp is

  • SabayApp connects customers with riders and stores for Sakay (rides by tricycle, single motor or car), Food & Mart (food and shop delivery), Pasabuy (a rider buys items for you) and Padala (parcel send or fetch) in Marawi City, Lanao del Sur.
  • Riders and stores are independent. They are not employees or agents of SabayApp. Each rider is responsible for their driving and vehicle, and each store for its food, goods, prices and permits.
  • We may pause a service, change features or put the app under maintenance at any time.

2. Your account

  • Give true details and keep them up to date. One account per person.
  • Keep your password secret. You are responsible for what happens in your account. Tell us at once if you think someone else used it.
  • You must be at least 18 years old, or use SabayApp with the permission of a parent or guardian. Riders and merchants must be at least 18.
  • Keep the app updated. We may require the latest version before you can continue.

3. Booking and orders

  • The price, the fees and the total are shown before you book: the fare or delivery fee, a service fee, and for Pasabuy a Pasabuy fee. The total you confirm is what you pay (for Pasabuy, see below).
  • Pickup and drop-off must be inside our service area.
  • Food & Mart: one store per order. The store confirms the order and says when it will be ready. Stores follow their opening hours.
  • Pasabuy: you give the shop, the list and an estimate (up to ₱2,000). Pasabuy is paid in advance. The rider buys with their own money, up to the estimate, and uploads the receipt. If the items cost less, the difference goes back to your SabayApp wallet.
  • Padala: give the name and mobile number of the sender or receiver. Do not send cash, alcohol, or anything illegal or dangerous. The rider takes a photo at delivery.
  • Tips go fully to the rider.

4. Paying

  • Cash on delivery where the app offers it, for orders up to ₱3,000. Have the exact amount ready.
  • Online through our payment provider, with the methods shown at checkout (such as GCash, Maya, QR Ph or card). The smallest online charge is ₱20; if less is left to pay, the extra goes to your wallet. An online order not paid within 30 minutes is cancelled.
  • Wallet credits can pay all or part of an order (not together with cash).

5. Cancelling

  • Food & Mart: you can cancel for free until the store confirms your order. After that, only the store can cancel it or change it (for example when an item is not available), until the rider picks it up; message the store if you need a change.
  • Rides, Pasabuy and Padala: you can cancel for free within 5 minutes after booking (after paying, for online orders), until pickup, and always while we are still looking for a rider. After that, a ride can still be cancelled while the rider is on the way, Pasabuy while the rider is shopping, and Padala before pickup.
  • If a rider is already assigned and the free time is over, a cancellation fee of ₱20 goes to the rider (online and wallet orders). The rest is refunded.
  • Cash orders have no fee. But after 2 cancelled cash orders that already had a rider, cash payment is turned off for your account.
  • A store may decline or cancel an order before the rider picks it up. An order also ends on its own when the store does not confirm it in time, or when no rider is found for a ride, Pasabuy or Padala. You then get a full refund.
  • If the store takes out an item it does not have, you are told at once and the difference goes back to your wallet (on a cash order you pay the rider the new total).

6. Refunds and wallet

  • Refunds go to your SabayApp wallet right away. In some cases our staff can refund to your original online payment method instead.
  • Wallet credits can only pay for SabayApp orders. Customers cannot withdraw them as cash or move them to another account, and they earn no interest. The wallet is not a bank account or e-money.

7. Rules for everyone

  • Be respectful and safe. No harassment, threats, violence or discrimination.
  • Do not break the law, cheat, use fake accounts or details, misuse coupons, refunds or the wallet, or try to hack or overload the service.
  • Do not order, sell or send anything illegal, stolen, fake or dangerous, or anything regulated without the needed permit (such as weapons, drugs or explosives).
  • No pork & liquor: in Marawi City (and any town SabayApp staff lock), no store may list pork or liquor and no order there may include them; the app blocks such items and may hide items already listed. In other BARMM towns, stores are marked "No pork & liquor" by default and each store may take the mark off. Any store elsewhere may mark itself. This is a listing rule: SabayApp does not certify any store or food as halal.
  • Ratings: after a completed order, customers can rate the rider and the store (1 to 5 stars and a comment). Be honest and fair. Staff may hide ratings that break these rules, but never change them.

8. For riders

  • You need a valid driver's license (not expired), a vehicle with a plate or body number, and our approval. We check your documents. You cannot go online with an expired license.
  • Follow traffic laws and local rules, and keep your vehicle safe and in good condition.
  • Take the required pickup and delivery photos. For Pasabuy, buy only up to the estimate and upload the receipt; what you spent is paid back to your wallet.
  • Cash: keep your own earning and remit the rest to SabayApp. When the cash you hold reaches ₱2,500, you get no new jobs until you remit.
  • If you hand back 3 jobs in one day, you are taken offline.
  • Your earning: SabayApp keeps 15% of ride fares and 15% of delivery fees; tips are all yours. Each job shows what you earn before you accept it.

9. For merchants (stores)

  • Keep your menu, prices, photos, opening hours and store details true and up to date. Items must be safe, as described and legal to sell.
  • Confirm or decline new orders quickly, and have them ready on time.
  • You are responsible for your permits, food safety and taxes.
  • Commission: SabayApp keeps 25% of the item subtotal of each order, unless we agree a different rate with you. Store coupons and item discounts are paid by your store.

10. Earnings and payouts (riders and merchants)

  • Withdraw your earnings to GCash, Maya or a bank account. The minimum is ₱100, and the most is ₱20,000 per day.
  • Each payout has a transfer fee of ₱10 and a SabayApp fee of 2%, taken from the amount.
  • New earnings from online-paid orders can be withdrawn after 0 hours. Store earnings from cash orders unlock once the rider's cash is remitted and checked.
  • After you change your payout account, withdrawals are locked for 1 days (our staff can unlock earlier); after a password change, payouts wait for a staff review for 24 hours. A failed payout goes back to your balance.
  • You are responsible for your own taxes.

11. Promotions and coupons

  • Stores can buy banners and ads in the app. Our staff review each one before it goes live. If we reject it, or you cancel it before it starts, you get a full refund to your wallet. If we stop a live promotion because it breaks these Terms, there is no refund.
  • Coupons follow the rules shown on them (dates, services, limits). Whoever issues a coupon pays for it. If an order is cancelled, the coupon can be used again. We may stop coupons that are misused.

12. Suspension

  • We may suspend a customer, rider or merchant account for breaking these Terms or the law, fraud, safety risks or repeated complaints. Suspension logs you out and stops new orders; your wallet balance stays.
  • Riders are also taken offline for an expired license, too much unremitted cash or too many handed-back jobs.
  • To ask for a review of a suspension, contact us.

13. Our responsibility

  • We work to keep SabayApp running well, but we cannot promise it will always be available or free of errors, and we do not control traffic, the weather, or what riders, stores and customers do.
  • As far as the law allows, SabayApp is not responsible for indirect or unforeseeable losses, and our responsibility for a problem with an order is limited to the amount paid for that order.
  • Nothing in these Terms takes away your rights under Philippine law, including the Consumer Act of the Philippines (Republic Act No. 7394), or limits our responsibility for fraud or gross negligence.
  • You are responsible for losses you cause by breaking these Terms or the law.

14. Governing law and disputes

These Terms follow the laws of the Philippines. Please contact us first so we can try to settle any problem. If we cannot, the proper courts in Lanao del Sur will decide, without taking away your rights under consumer protection law.

15. Changes to these Terms

We may change these Terms. We will post the new version here with a new date, and tell you in the app when a change is important. If you keep using SabayApp, you accept the new version.
